Please read these Terms carefully before using KartCoach. By creating an account or using the app, you agree to be bound by these Terms.
KartCoach is a telemetry analysis and coaching platform for kart racing, operated by Foundation 51 Holdings LLC ("KartCoach," "we," "us," or "our"), a Texas limited liability company. The platform connects drivers with performance data from their AiM MyChron data loggers and with professional coaches.
These Terms of Service ("Terms") govern your access to and use of the KartCoach iOS application, website at kart-coach.com, and all related services (collectively, the "Service").
You must be at least 13 years of age to use KartCoach. If you are between 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the Service you represent that you have the legal capacity to enter into a binding agreement.
You must create an account to use most features of KartCoach. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.
Access to telemetry analysis features requires an active paid subscription.
We reserve the right to change subscription pricing with at least 30 days notice to active subscribers.
KartCoach operates a marketplace that allows professional karting coaches ("Coaches") to offer coaching services to drivers ("Drivers"). The following terms apply to marketplace transactions:
Platform Role
KartCoach is a platform connecting Coaches and Drivers. We are not a party to coaching sessions and are not responsible for the quality, safety, or outcome of any coaching engagement. Coaches are independent professionals, not employees or agents of KartCoach.
Booking and Payment
When a Driver books a coaching session, their payment card is authorized at the time of the booking request. The charge is captured only when the Coach confirms the session. If the Coach declines, no charge is made.
Platform Fee
KartCoach charges a platform fee on each completed coaching transaction. This fee is deducted from the Coach's payout. The current fee rate is displayed to Coaches in their dashboard and in our fee schedule.
Cancellations and Refunds
Sessions cancelled before confirmation receive a full refund automatically. Sessions cancelled after confirmation are subject to the cancellation policy agreed between the Driver and Coach at the time of booking. KartCoach may issue refunds at its discretion in cases of dispute.
Coach Responsibilities
Coaches are solely responsible for the content and quality of their coaching, their availability, their credentials, and their compliance with applicable laws. Coaches must be at least 18 years of age.
You retain ownership of the telemetry data you upload to KartCoach. By uploading data you grant KartCoach a limited license to process, store, and analyze that data for the purpose of providing the Service to you.
KartCoach does not claim ownership of your session data. We will not sell your individual telemetry data to third parties.
The KartCoach application, coaching algorithms, user interface, brand, and all related intellectual property are owned by Foundation 51 Holdings LLC. You may not copy, modify, reverse engineer, or distribute any part of the Service without our written permission.
KartCoach uses artificial intelligence to generate coaching language from your telemetry data. You acknowledge that:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Telemetry analysis and coaching content are provided for informational purposes and may contain errors.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOUNDATION 51 HOLDINGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Foundation 51 Holdings LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. When we do we will update the effective date and notify active users by email or in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
If we make material changes that adversely affect your rights, we will provide at least 30 days notice before the changes take effect.
